At the beginning of 2023, the woman submitted a late application to the EU settlement scheme. Her application was rejected in June 2022 on the grounds that she had not provided all the required information, but she had requested an administrative review of the decision.
From that moment on she had a certificate of application issued by the Ministry of the Interior. It says: “You can work in the UK until you receive a decision on your application for the EU payment system.”
Maria lived in the UK from 2014 to 2018. The woman then went to South Africa with her husband, where her husband received his doctorate. Shortly afterwards she was unable to return to the UK due to Covid-19 restrictions. She then returned to live in Britain again.
Under the rules she is allowed to make a late application, but she must prove that the period of time away from the UK has not passed.
