NRC and De Limburger published lawfully about favoritism to CDA member Knops

CDA member Raymond Knops, former Member of Parliament, State Secretary and Minister, has appealed lost the lawsuit which he had filed against NRC in The Limburger. The two newspapers wrote in 2020 after research that the CDA member had been favored when purchasing a building plot for tens of thousands of euros compared to others who used the same scheme. According to Knops, there was no favoritism.
But the court now rules that there was nothing wrong with the publications and that the allegations were supported by facts “in all respects.”
In recent years, Knops turned the lawsuit into a personal attack on NRC investigative journalist Joep Dohmen, one of the authors of the articles. During the trial in the first instance, he said that he had not only gone to court for himself, but also on behalf of all those other hardworking administrators and politicians who are affected by fake news. Knops stated that he would stand up for the victims of “Dohmen’s gang”. He called the NRC journalist “malicious”, with a “poisoned pen as a weapon”, with which he apparently wanted to force politicians to resign. According to Knops, it was ‘undermining for the rule of law’.
No careless actions
But the court now states in its judgment that there was no question of careless conduct and that it is right that NRC paid attention to the “action of directors”. “Because of his high-level political and administrative functions, Knops is a public figure and must therefore accept more than usual attention from the media, also in his private actions, especially when he makes use of public arrangements,” the court ruled. .
The case revolved around Knops’ purchase of land in 2010 in his hometown in Limburg. The purchase was made via the so-called room-by-room arrangement. This allowed private individuals to convert agricultural land into residential land through a company from the province of Limburg. While others generally bought 1,000 square meters of residential land, Knops bought a residential plot from the provincial space company that, according to the notarial deed, was 750 square meters in size, but when measured by the Land Registry turned out to be 1,175 square meters.
Tens of thousands of euros
Because Knops had paid for 750 square meters, NRC and De Limburger concluded that the CDA member had been favored by ‘tens of thousands of euros’. The court had ruled in 2022 that Knops was indeed advantaged, but that NRC could not write that it involved tens of thousands of euros. It was the only point on which Knops was right in court. The court now also strikes out this and rules that enough facts have been provided for this by NRC and De Limburger.
After purchasing it from the municipality, Knops was even allocated 1,500 square meters of residential use. Then research showed from the newspapers that Knops wanted to build a larger house on that building plot than was permitted under municipal rules. Despite negative official advice, councilors decided to scrap internal rules to make this larger home possible. More than a year after Knops was able to build his home in this way, this option was formally included in municipal policy.
Knops was also ordered by the court to pay the legal costs of the lawsuit at first instance and the appeal.
Knops was not yet available for comment.
Correction April 23: The intro to this article stated that Knops litigated all the way to the court. Knops filed the lawsuit, but NRC appealed. That has been adjusted.
