Türkiye is in a process of change. The crises of judicial behavior that we are experiencing reflect the destruction wrought by the “Turkish-style presidential system,” which is still in the institutionalization and establishment phase. Although the nature of administration has changed in 2018, the state mechanism has not yet achieved a structure and functioning suitable for the new regime. Institutions, bureaucratic processes and practices that come from the old system and hinder the functioning of the new order become an obstacle to government.
Just as the one-man regime has deactivated the political instruments that would balance its authority, it also aims to eliminate the legal bases that have provided the people, parties, movements and even ideas that it has ideologically condemned would allow breathing. Therefore, today we are facing the second part of the establishment phase of the new regime. As the regime seeks to destroy the last broken pillars of the separation of powers, it is packaging the operation it is conducting as “national justice.” Because the slogan “Palace Justice” may not seem very attractive.
This information has not yet been published in the Official Gazette, but in the transitional period we are in, there is in fact no Constitutional Court at the top of Turkey’s legal hierarchy, tasked with upholding the Constitution. At this historic turning point, where they appear arm in arm, they are closer to their goals than ever before. Only one force can stop them: an organized and dynamic social opposition in all areas of life, united around left-wing values against all injustice and lawlessness.
