JAKARTA, KOMPAS.com – Minister of Law and Human Rights (Menkumham) Yasonna Laoly said he has heard information about the Anti-Corruption Commission (KPK)’s plan to appeal the 14-year prison sentence of Rafael Alun Trisambodo.
Rafael is the former head of the general department of the Directorate General of Taxes (DJP) in the South Jakarta (Kanwil) regional office.
“Yes, it’s up to the court’s decision. I heard that the Corruption Eradication Commission (KPK) (wants to) appeal,” Yasonna said on Tuesday (September 1, 2024) at the Presidential Palace in Jakarta.

“Yeah, we’ll just have to wait and see. Let the legal process take place,” he added.
Previously, Rafael was sentenced to 14 years in prison and a fine of IDR 500 million, as well as a three-month prison term.
He was also ordered to pay compensation of IDR 10,079,055,519. The KPK prosecutor demanded that Rafael be sentenced to a fine of 1 billion rupiah, a subsidiary prison sentence of 6 months and compensation of 18.9 billion rupiah.
The panel of judges of the Corruption Court concluded that Rafael was legally and convincingly proven to have committed criminal acts of corruption, as set out in the three indictments filed by the Corruption Eradication Commission (KPK) prosecutor.

The charge is governed by Article 12B read in conjunction with Article 18 of the Law of the Republic of Indonesia No. 31 of 1999 on the Elimination of Corruption Crimes read in conjunction with Article 55 paragraph (1) 1 of the Penal Code read in conjunction with Article 64 paragraph (1). ) of the Criminal Code regarding gratification that is considered a bribe. Then Article 3 paragraph 1 letters a and c of Law No. 25 of 2003 on the crime of money laundering in conjunction with Article 55 paragraph 1 of the Penal Code in conjunction with Article 64 paragraph 1 of the Penal Code.
Then Article 3 of Law No. 8 of the Republic of Indonesia of 2010 on the Prevention and Elimination of the Crime of Money Laundering in conjunction with Article 55(1)(1) of the Penal Code in conjunction with Article 64(1) of the Penal Code.
The Anti-Corruption Commission’s Enforcement and Institutions Spokesman Ali Fikri previously said that the Anti-Corruption Commission commends the panel of judges of the Jakarta Central Corruption Criminal Court regarding Rafael’s decision to sentence Rafael to 14 years in prison and a fine of Rp 500 million (Tipikor) .

The corporal punishment imposed by the panel of judges met the demands of the KPK prosecutor’s office.
However, the prosecutor’s requests contained several points and considerations that the jury did not take into account.
“So within the next seven days we need to think about expressing our position on the next legal steps,” Ali told reporters on Tuesday.
