The anti-competitive company Maroc Telecom ordered the payment of 6.38 billion dirhams to Inwi
The decision was made this Monday: IAM (Maroc Telecom) is ordered to pay no less than 6.4 billion dirhams (MMDH) in the dispute between it and Inwi. This initially required 6.8 MDH. The decision comes from the Rabat Commercial Court.
The process lasted more than two years. It started, as we previously reported, in December 2021 with a complaint filed by Wana. The allegations were of actions aimed at hindering competition and misusing a dominant position in the internal market.
The Wana Group has decided to engage the services of Hamid El Andaloussi, member of the International Court of Arbitration, known for assisting several influential figures in their disputes, including Prince Moulay Rachid.
The Wana Group had previously filed a complaint. It was eventually retracted: “ on the initiative of the directors of Al Mada Holding Company,” in February 2020: “ “Having noted the decision of the National Telecommunications Regulatory Authority (ANRT) to condemn Morocco for anti-competitive practices in the fixed-line market”says a press release from Wana, which markets the Inwi brand.
“The Board of Directors (CA) of Wana has no doubt that the measures and interim measures taken in this context will make it possible to restore healthy competition in the telecommunications market, in the interests of consumers and businesses, and in strict compliance with applicable laws and regulations.” ”noted the same source.
Therefore, confident in the prospects of consolidation and development of the telecommunications sector, the CA, at the suggestion of Al-Mada administrators, decided to terminate the lawsuit initiated in 2018 against Maroc Telecom in the Rabat Commercial Court, the press release said.
The decision to withdraw the complaint followed the fine imposed by the ANRT on the company Maroc Telecom a few days earlier. This was decided in the amount of 3.3 billion dirhams “Conduct that constitutes an abuse of a dominant market position”.
Later, at the beginning of the Covid-19 pandemic, the fine of 3.3 billion dirhams was paid into the special fund, according to initial information from the Kingdom’s General Finance Ministry. Maroc Telecom’s 2020 financial statements show an interim contribution of MAD 1.5 billion.
