The public prosecutor’s office (OM) believes that 17-year-old Jenairo H. should be sentenced to two years in prison and TBS for stabbing his superior at the Yorneo youth center in Emmen. 26-year-old Marit from Groningen was killed in January last year when H. and a friend tried to steal the safe.
According to the public prosecutor’s office, H. is guilty of qualified manslaughter. The employee was killed to make the theft possible. H. lived in the institution at this time. He used a pretext to lure his superior into his room, where the woman was almost immediately stabbed in the neck.
Although the boy is 17 years old, the public prosecutor’s office is of the opinion that H. should be sentenced under adult criminal law. For this reason, DBS is necessary for adults. The public prosecutor’s office therefore demanded a prison sentence of two years, the maximum penalty in juvenile criminal law.
Agnes Veld, Jenairo H.’s lawyer, is of the opinion that juvenile criminal law should be applied. In her opinion, the teenager is young and therefore still sensitive to pedagogical influence. Veld believes that the prosecution’s argument that TBS in juveniles can last a maximum of seven years and then the boy returns to society with inadequate treatment is too premature. “Since 2014, it has been legally possible to convert juvenile TBS into adult TBS.”
The public prosecutor’s office determined that H. stabbed. His friend, 20-year-old Arek K., kicked the woman in the head as she lay bleeding profusely on the ground. A girl who lived in the institution witnessed the incident. She was held by K. so that she couldn’t call for help. The child was later able to raise the alarm in an adjacent restaurant. K. must appear in court on Thursday for his involvement in the fatal theft.
H. and his friend were arrested shortly afterwards. The teenagers were sent that evening by 20-year-old Jermaine S. from Emmen to rob a gas station. They were given clothing, face coverings and a knife. The pumping station was closed. The boys then decided to steal the institution’s cash register.
The amount of money the boys stole from the institution was only a few hundred euros. According to the public prosecutor’s office, the teenager’s sole aim was self-enrichment. This resulted in a brutal and ruthless act. “The suspect’s actions were also cold and calculating.” He always denied having killed the woman.
According to prosecutors, the knife was used to kill Marit. The boys had been put under pressure by the 20-year-old resident of Emmen and did not dare to return empty-handed. The public prosecutor assumes that her client is partly to blame for Marit’s death. Jermaine S. will be brought to court next Monday.
According to the public prosecutor’s office, the incident in Yorneo is not an isolated case. Behind it was a group of young people who, in different compositions, had committed several crimes. They were settled in S.’s house, which also served as a base for the gang members. Four youth gang suspects will appear in court in Assen in the coming days.
