The Economic Competition Authority initiated competition supervisory proceedings against Lidl Hungary. According to the competition authority’s suspicions, the retail company, which operates around 200 stores nationwide, used misleading communication about some of its products that were advertised as “whole grains”.

The Economic Competition Authority has determined that Lidl Magyarország Kereskedelmi Bt.’s four products are marketed with the “whole grain” label (whole grain nostalgic cookies, whole grain Stangli PurPur, whole grain scones with seeds and cocoa snails made from whole grain flour with sweeteners). ) contain a lower proportion than fine wholemeal flour, according to the GVH statement.

This is what the company calls the products and the “whole grain” With its commercial communication from June 6, 2020, which included the indicator, it is likely to have misled consumers, particularly with regard to the composition of the products and therefore their effect on health.

In connection with the initiation of the procedure, the GVH points out that when developing their commercial communications, companies must pay attention to how consumers interpret their message and cannot expect consumers to investigate the truth of the claims. The national competition authority pays particular attention to claims relating to the health effects of certain products, as certain consumer groups – for example those who follow a specific diet – are particularly exposed to these claims.

The initiation of the competition supervisory procedure does not mean that the company has committed the infringement. The aim of the procedure is to clarify the facts and thus prove the alleged violation. The duration of the procedure is three months and, in justified cases, can be extended twice by a maximum of two months each.
