France fines Amazon €32 million for “surveillance of employees”

On Tuesday, France’s data protection agency fined Amazon France Logistics €32 million for introducing a system to monitor employees who made “excessive interference” in their activities.

France’s National Commission for Information Technology and Freedoms told AFP that the fine was equivalent to about three percent of the company’s turnover, an “almost unprecedented” figure.

The maximum penalty that could be imposed on the company was 4 percent.

In 2021, Amazon France Logistics’ sales volume reached 1.135 billion euros, with a net profit of 58.9 million euros.

After four years of investigation and legal analysis, the Commission concluded that, under the GDPR, Amazon France Logistics had introduced “an overly intrusive system of monitoring employee activity and performance” using scanners used by employees in Warehouses were used for parcel processing.

According to the French Commission, these scanners record inactivity times of more than ten minutes or the parcel processing rate “to the second”.

An Amazon spokesperson responded in a statement: “We strongly disagree with the NCLTRC’s conclusions, which are factually incorrect, and reserve the right to appeal.”

Amazon France, a subsidiary of the giant American e-commerce group, employs more than 20,000 permanent employees, some of whom work for Amazon France Logistics, which operates large warehouses, including eight distribution centers.

Three indicators collected by scanners and sent to managers attracted particular interest from the National Commission on Information Technology and Freedoms.

These include an indicator called “Gun-Gun,” which detects when an item is scanned through the device “very quickly,” in less than 1.25 seconds, and another that measures “idle time,” which is a period of time scanner inactivity refers to more than ten minutes.

A third indicator also measures the elapsed time “between the time the employee logs in at the site entrance” and the time their first package is scanned.

The agency believes that this system forces employees to justify any interruption to their scanner activity, even if it lasts only “three or four minutes,” which represents “constant pressure on them.”

The group has two months to appeal the decision.
