MUMBAI – The legal battle following Shiv Sena’s split will continue. Accusing the Speaker’s decision of killing democracy, Uddhav will also go to the people’s court describing the BJP and Shinde’s conspiracy to destroy the party. With elections approaching, sympathy will be the most important weapon.
Shinde, along with the BJP, toppled the Uddhav government in June 2022 and took over as chief minister. The observation from the Uddhav side is that the Speaker’s judgment has a lot of things in it which they can use in their favor in the Supreme Court litigation.
Sharad Pawar’s response is that the Speaker’s judgment is a “political judgment”. Maharashtra PCC also expressed its strong support for Uddhav. The Congress and NCP Pawar’s side may also consider giving more seats to the Uddhav faction in the Lok Sabha elections to capitalize on the sympathy.
The Uddhav party based its arguments on the Shiv Sena constitution, which was amended in 2018. However, the speaker relied on the 1999 constitution approved by the Central Election Commission.
