The 2001 law provides that, from now on, if the archaeological services of the Ministry of Culture, within the regional directorates of cultural affairs, consider that a development risks affecting an archaeological site, they prescribe preliminary surveys, or diagnostics. Such surveys can only be carried out, to be certain of their objectivity, by public services: either the sixty archaeological services of communities (cities, urban communities, departments), or the National Institute of Preventive Archaeological Research [Inrap].

Surveys are nevertheless only prescribed on a quarter of the approximately 50,000 hectares developed (or artificialized) each year, for various works, constructions, communication routes, quarries, etc. – or the surface area of ​​a department every ten years. It is estimated that there are between 5 and 10 million sites from all periods – France having been occupied by humans for at least a million years – a certain number of which have already been destroyed. In view of the surveys, real excavations are only prescribed in a quarter of cases, therefore only 6% to 7% of development operations are in fact concerned by preventive excavations – their cost being covered by the State for individuals building for themselves or for small developers.
