The Apple Watch has returned to the market after Apple’s patent dispute with medical device manufacturer Masimo is still ongoing.
In a new interview with the Wall Street Journal, Masimo CEO Joe Kiani explained in detail why he was determined to fight Apple to the end: “Nobody stands up to them. If you can do that, it could change Apple for the better.”, according to 9to5mac.
In the interview, Kiani said that Masimo has so far spent about $100 million fighting Apple, a fight that began in January 2020, and as the Wall Street Journal notes, Masimo’s total winnings for 2022 were about $144 million U.S. dollar.
Before he joined Apple, Massimo employees and Kiani’s friends warned him about the risks involved. “People told me I was crazy and couldn’t take action against Apple,” Kiani said. “You have unlimited resources.”
Although Masimo’s battles with Apple will likely end years later, the company has successfully won similar cases in the past.
In 2006, Kayani prevailed in a seven-year patent dispute with Nellcor, a company that was then the leading provider of a competing pulse oximetry device, and in 2016 he prevailed in another patent infringement case against Royal Philips.
As part of the Nelcor settlement in 2006, Masimo received approximately $800 million in damages and royalties, and as part of the Royal Philips settlement in 2016, the company paid Masimo $300 million and agreed to a licensing agreement that ” raised more than $1 billion for Masimo.” ”
Kiani says Apple has not yet had “serious settlement discussions” with Masimo. In previous interviews, Kiani said that Masimo was open to a deal with Apple, but that “it takes two people to tango.”
“I feel like I have to do this,” Kiani concludes. “If I can stop the most powerful company in the world from continuing to behave badly, that will have a greater impact on the world than anything else I do.”
