Chief Justice of Islamabad High Court Aamir Farooq while hearing a petition of former Prime Minister Imran Khan said that Rawalpindi’s Adiala Jail is better for under-trial prisoners than Attock.
During the hearing on Wednesday, the point was raised that Imran Khan has been kept in Attock Jail in the cipher case after the suspension of sentence in the Tosha Khana case, while usually under-trial accused are kept in Adiala Jail.
The Chief Justice inquired from the government lawyer whether there was any decision or notification to keep PTI Chairman in Attock Jail after the sentence was suspended.
The Chief Justice said that the main objection of the petitioner is that the trial court asked to keep him in Adiala Jail, why was he transferred to Attock Jail?
‘Has the superintendent of Adiala jail requested to keep PTI chairman in Attock jail?’
On this occasion, Imran Khan’s lawyer Sher Afzal Marwat said that PTI chairman’s sentence is now suspended and he has got bail. ‘Now his detention status has changed.’
The Punjab government has informed the Islamabad High Court that Pakistan Tehreek-e-Insaf Chairman Imran Khan has been given a better class in Attock jail, where he is being provided with a bed, a chair, a 21-inch TV, five newspapers and free meals. .
The Assistant Advocate General of Punjab Province said on Wednesday during the hearing of a petition on behalf of Imran Khan before the Islamabad High Court that the problem of the bathroom in the former prime minister’s cell has also been resolved.
‘The bathroom walls have been raised and whitewashed.’
He further told the court that A and B classes have been abolished in Attock Jail, but Imran Khan has been provided with a better class and all his problems have been solved. On this, Assistant Advocate General of Punjab province informed the court about the details of facilities available to Imran Khan in Attock Jail. On this, the Chief Justice remarked that it is true that Imran Khan is not currently serving his sentence. “They are in custody in another under-trial case and trial prisoners are kept in Adiala Jail within Islamabad.”
Imran Khan’s lawyer Sher Afzal argued that there is no B class in Attock jail and this is being done only to cause pain.
Officials say that he has been kept in Attock Jail for security reasons. It should be told whether Adiala Jail is more secure or Attock Jail? This is known to all.
“Sardar Latif Khosa has met Chairman PTI and he told that there are many unknown prisoners in Attock Jail.”
Lawyer Sher Afzal further said that ‘Where Imran Khan is kept in Attock Jail, there is no roof, water falls, Imran Khan does not sleep at night, there are flies.’

Chief Justice Amir Farooq inquired that in the cipher case, he is an under-trial accused, can the jail be changed during the trial? The trial is to be held in Islamabad.
Sher Afzal Marwat told the court that at present the chairman PTI is not in jail as a convicted accused, but his sentence is suspended in the Tosha Khana case. Chairman PTI has been kept in jail as an under-trial accused in the cipher case.
The Chief Justice remarked that there is no model prison in Pakistan.
The Chief Justice further inquired that after the suspension of the sentence, any new order has been issued regarding keeping the Chairman PTI in Attock Jail? The Assistant Advocate General replied to the court that the court will be informed by taking instructions in this regard.
The Chief Justice said that still all under-trial prisoners are brought from Adiala Jail.
He indicated to issue the order on the request and said that
The court ordered the jail authorities to meet Sher Afzal Marwat with Chairman PTI and adjourned the hearing till September 11.
Trial in Attock Jail
Apart from this, Chief Justice Islamabad High Court heard the request of Imran Khan against hearing the cipher case in Attock Jail.
The FIA’s lawyers sought a week’s time to file a reply to which the Chief Justice inquired that the notification to change the venue of the hearing was dated August 30. ‘The question is whether the next hearing will also be held in jail or the notification was only for one hearing?’
He further said that ‘Ministry of Interior becomes the relevant ministry, how did the Ministry of Law make this notification?’
The prosecution lawyer responded and said that the court will be informed by taking instructions in this regard.
