Judge buys a rightful claimant of the IMSS so that the Xicoténcatl clinic gives him medicine for life – Gaceta de Tamaulipas

Ciudad Victoria, Tamaulipas.- Through ruling 1716/2020, the Federal Judicial Power granted protection to a citizen so that the Family Medical Unit No. 5 of the Mexican Institute of Social Security (IMSS) in Xicoténcatl granted her the medicine she needs from for life, since by not doing so the constitutional guarantee of health was violated, and seriously endangers the life of the rightful claimant from Tamaulipas.

Judge Fernando Ureña Moreno, head of the First District Court in Victoria, ruled: “The Justice of the Union SHELTERS AND PROTECTS (…), against the acts specified in the second recital and claimed from the responsible authorities IMSS and the Medical Unit Family Member No. 5, Xicoténcatl, Tamaulipas, for the grounds and reasons set forth in the last considering paragraph of this judgment and for the effects specified therein. Please notify yourself.”

On December 17, 2020, the beneficiary went before the Federal Judicial Power in this capital to file a lawsuit against the aforementioned IMSS Clinic, for the refusal to grant the medicine prescribed by the doctor, which he considered a violation of article 4 of the Political Constitution of the United Mexican States, presenting the evidence and its legal arguments.

The citizen claimed the omission that remains to date of providing her with the 10 mg Rivaroxaban medication, since she needed it for life and does not have the necessary resources to acquire it, which endangers her health, integrity and life, but also As a beneficiary of the IMSS, the agency is obliged to provide it, because that is the purpose for which it was created and there should not be the slightest excuse to deny any legal benefit.
