JN reveals that less than half of those detained by PSP and GNR have been tried. In addition only a small fraction of drivers are convicted. On average 22 drivers are picked up without a driving license. Two more than six thousand detainees, just over 100 were sentenced to effective imprisonment.
Within the justice system, the option for provisional suspensions of proceedings, which do not involve a trial, is defended.
Driving without a license is a crime
In Portugal driving without a license gives you two years in prison. According to the Highway Code, Article 121, a motor vehicle may only drive on a public road if it is legally entitled to do so.
Driving licenses and licenses are issued by IMT, I. P. These are issued to individuals who prove they fulfill their legal requirements. They are valid for the categories of vehicles and for their time periods.
A driver who violates any of the duties set out in the Driving License (RHLC) Regulation is sanctioned with a fine of (euro) 60 to (euro) 300, if a more severe penalty does not apply.
Anyone driving a vehicle of any category for which their driving license does not qualify is fined from € 500 to € 2500.
